Ratio Decidendi

The court found that the claimant was dismissed and did not abscond duty, as there was no dismissal letter or credible evidence of abscondment. The respondent failed to accord the claimant a hearing or follow the procedure required under Section 41 of the Employment Act. The dismissal was therefore unfair and unjustified under Section 45(2) of the Employment Act. However, claims for service pay and leave pay prior to 2007 were time-barred, and overtime was not proved. The claimant was awarded one month’s salary in lieu of notice and six months’ salary as compensation for unfair termination, with costs and interest.
