Ratio Decidendi

The court found that while both the present suit and HCCC No. 265 of 2008 concern the same property (L.R. Limuru/Ngecha/1120) and involve substantially the same parties, the reliefs sought in the present suit are broader and subsume those in the earlier suit. HCCC No. 265 of 2008 has already been declared res judicata in relation to HCCC No. 508 of 2003, and maintaining it would risk rendering the present suit res judicata as well. The court concluded that the plaintiff would not be prejudiced by abandoning the earlier suit and pursuing the present one. The application for consolidation was therefore dismissed, and the parties were directed to prepare the present suit for hearing.
