The court found that there was a substantive dispute as to whether a valid contractual relationship existed between the applicant and the 2nd respondent, and whether the procurement of legal services complied with the mandatory statutory requirements under the Public Procurement and Asset Disposal Act. The court held that until this dispute is resolved, it cannot find that a public duty to pay the applicant has crystallised. Furthermore, the court's judicial review jurisdiction does not extend to resolving such contractual disputes or compelling the exercise of discretion in a particular manner. As such, the application for an order of mandamus was premature and could not be granted.
