Ratio Decidendi

The court held that it is mandatory under Section 333(2) of the Criminal Procedure Code to take into account the period an accused person has spent in custody prior to sentencing. The applicant, Agnes Gakii Kingangi, was unable to meet bail terms and remained in custody from 13th January, 2016 until her conviction and sentencing on 23rd January, 2020. The court found that she is entitled to have her sentence computed from the date she was first remanded in custody. However, the court declined to review the sentence or order her release, noting that no appeal against sentence had been filed and such relief was not available in the present application.
