The court held that it lacked the power to transfer a suit that was filed in a court without territorial jurisdiction. Section 18 of the Civil Procedure Act only permits transfer between courts of competent jurisdiction. Since the Machakos court had no jurisdiction over the subject matter, the suit was incompetent ab initio and could not be transferred to the Milimani Chief Magistrate’s Court. The court further found that neither Order VII Rule 9 of the Civil Procedure Rules nor the Practice Directions issued by the Chief Justice could cure the jurisdictional defect or confer jurisdiction where none existed.
