Ratio Decidendi

The court found that the 2nd and 3rd Defendants had no legal authority to sell the suit property as they had not obtained confirmation of grant at the time of sale. The purported transfer was signed in the name of the deceased long after his death, rendering the transaction fraudulent and void. The registration of the 1st Defendant as proprietor was therefore obtained by fraud. The court relied on statutory provisions under the Law of Succession Act and the Land Registration Act to hold that the register should be rectified to restore the property to the estate of the deceased, represented by the Plaintiffs.
