The court found that the plaintiff and her late husband initially occupied the suit land with the permission of the registered owner, Paul Kudondo, pursuant to a sale agreement whose terms could not be verified due to lack of documentary evidence and failure to obtain Land Control Board consent. Permission was only withdrawn in 2011, and thus, the period of occupation prior to that date could not be counted towards adverse possession. By the time the suit was filed in 2014, only about three years had elapsed since the withdrawal of permission, falling short of the 12-year statutory requirement for adverse possession.
