The court found that although the subject matter in the previous suits cited by the respondent was the same as in the present suit, the parties were not identical. In particular, some defendants in the earlier cases were different and did not participate in those proceedings. The court held that for the doctrine of res judicata to apply, the parties must be the same or litigating under the same title, and the matter must have been finally decided by a competent court. Since there were differences in parties and lack of disclosure regarding all parties on the suit land, the court concluded that the present suit was not res judicata.
