Ratio Decidendi

The court found that the 2nd and 3rd Defendants actively participated in the application that resulted in the dismissal of the Plaintiff's suit for want of prosecution. Both had filed defences and sought dismissal with costs. The law under section 27(1) of the Civil Procedure Act provides that costs follow the event, and the court has discretion to determine by whom and to what extent costs are paid. There being no reason to depart from the general rule, and the Plaintiff having failed to oppose the applications for costs, the 2nd and 3rd Defendants were deemed successful parties and entitled to recover their costs from the Plaintiff.

Court Disposition

Applications for costs by the 2nd and 3rd Defendants allowed.

Orders

  • The Plaintiff shall pay the 2nd Defendant’s costs of his Notices of Motion dated 25th February, 2010 and 21st March 2013, and the costs of this suit.
  • The Plaintiff shall pay the 3rd Defendant the costs of his Notice of Motion dated 14th October 2013 and the costs of this suit.
