Criminal Petition / Sentence Review Application
Legal Issues
- 1 Whether the applicant has provided sufficient material for the court to review the sentence imposed for gang rape.
- 2 Whether the absence of records from the trial and appeal courts precludes consideration of the sentence review application.
Ratio Decidendi
The court found that the applicant failed to provide any material evidence, including records of the trial or appeal, to support his application for sentence review. Without such documentation, the court is unable to assess the merits of the application or determine whether the sentence was appropriate. The absence of essential records renders the application devoid of merit, leading to its dismissal.
Court Disposition
Application dismissed for lack of merit.
Orders
- The application for sentence review is dismissed.
- File closed.

Ruling
1. I have considered the application dated October 30, 2023 for Sentence Review. The applicant was convicted and sentenced to serve fifteen (15) years imprisonment for Gang Rape vide Winam SPM Sexual Offences Case No. 1 of 2018.
2. He cites HCCRA No. 46 of 2019 as an appeal and he does not indicate its outcome or whether it is still pending in court. No copies of proceedings and judgment of the trial court or the appeal have been annexed.
3. I find no material upon which I can consider the application as filed.
4. The application is found to be devoid of merit and is hereby dismissed.
5. File closed.
