Ratio Decidendi

The court found that the judgment delivered on 24th June 2016 was based on the mistaken belief that Kshs 550,860 had been released to both counsels for deposit in a joint interest earning account, when in fact this had not occurred. This constituted an error apparent on the face of the record. The court acknowledged the need for correction but determined that, given the nature and depth of the correction required, the judge who delivered the original judgment (Makau J) was best suited to consider the request for review. Accordingly, the file was ordered to be remitted to Makau J for determination of the review application, with the aim of bringing the long-standing matter to closure.
