The plaintiff was entitled to a refund of the deposit paid (Kshs 1,000,000/-) as admitted by the defendant, and only those special damages that were strictly proved (Kshs 357,000/-). The claim for general damages for breach of contract was rejected as such damages are not recoverable in law for breach of contract, especially given the ambiguous nature of the agreement and lack of due diligence. Judgment was therefore entered for the plaintiff for the sum of Kshs 1,357,000/- with interest at court rates and costs of the suit.
