The court found that, given the Defendant's assertion that the works complained of by the Plaintiff were carried out by the Rural Electrification Authority (REA), and to avoid a multiplicity of suits should it be established that REA was indeed responsible, it is necessary to join REA as a defendant. The court emphasized that under Order 1 Rule 10(2) of the Civil Procedure Rules, it has the power to add any party whose presence is necessary for the complete adjudication of the dispute. The court also noted that no decree can bind a person who is not a party to the suit.
