The court found that the ruling delivered by the Magistrate's Court on 5th February 2021 was a negative order dismissing the appellant's application to set aside judgment and did not contain any positive obligation capable of being stayed. Therefore, the application for stay of execution was misconceived and could not be granted. On the issue of summary rejection, the court held that the memorandum of appeal raised triable issues, particularly regarding service and the rejection of the appellant's defence, and thus did not meet the threshold for summary dismissal under Section 79B of the Civil Procedure Act.
