The court found that the Petitioner failed to provide evidence of manipulation, undue influence, or abuse of process by the Director of Public Prosecutions in instituting the criminal proceedings. The mere existence of a parallel civil suit in the Environment and Land Court does not, in itself, justify quashing or prohibiting the criminal case, as Section 193A of the Criminal Procedure Code expressly allows for concurrent civil and criminal proceedings arising from the same facts. The Petitioner did not demonstrate that his right to a fair trial under Article 50 of the Constitution was infringed, nor did he show that the prosecution was actuated by malice or bad faith.
