In this case, the applicant failed to demonstrate that it would suffer substantial loss if stay was not granted, nor did it show that the intended appeal would be rendered nugatory. The court found that the only consequence of refusing stay would be that the advocate would proceed to recover taxed costs, which is a money decree, and there was no suggestion that the advocate could not refund the costs if the appeal succeeded.
