The Employment and Labour Relations Court lacks original jurisdiction to enforce awards of the Director of Work Injury under the Work Injury Benefits Act, 2007. Both the Applicant and Respondent must first exhaust the administrative review and enforcement mechanisms before the Director, as stipulated in Sections 51 and 52 of the Act. The Court's role is limited to hearing appeals from the Director's decisions on objections. Subsidiary legislation, such as the E&LRC [Procedure] Rules, 2024, cannot expand the Court's jurisdiction beyond what is conferred by statute.
