The court held that when it is brought to its attention that the record of appeal is incomplete, it cannot proceed to hear and determine the appeal until the record is regularized. The argument that only the appellant can file records of appeal is misplaced, as all parties with an interest in the outcome of the appeal have a right to ensure the record is complete. The 1st respondent's application to file a supplementary record of appeal was therefore allowed to ensure the appeal is determined on a complete record, in accordance with Order 42 Rule 13(4) of the Civil Procedure Rules.
