The court found that the liquidator failed to prove on a balance of probabilities that the sum of Kshs.241,442,375.80 was lost by Trust Bank Limited, as evidence showed that 24 bankers cheques totaling Kshs.146,687,402.50 were never honoured and were reversed, and a further Kshs.96,500,000 was paid directly to the bank, extinguishing any liability.
