Ratio Decidendi

The court found that the respondent was properly served with the application and did not dispute the certificate of taxation. Under Section 51(2) of the Advocates Act, the certificate is final as to the amount unless set aside or altered, and the court may enter judgment for the certified sum. The applicant was therefore entitled to judgment for the taxed costs. However, the court declined to award interest because there was no evidence that a claim for interest was made as required by Regulation 7 of the Advocates (Remuneration) Order. On costs, the court exercised its discretion and directed each party to bear its own costs since the respondent did not oppose the application.
