Ratio Decidendi

The court found that the appellant's application for stay of execution was made promptly and that the appellant had demonstrated an arguable appeal. Although the respondent did not rebut the appellant's assertion regarding his means, the decretal sum was modest (Ksh. 100,000). The court held that the interests of justice required balancing the appellant's right to have the appeal not rendered nugatory with the respondent's right to enjoy the fruits of judgment. The court therefore granted a conditional stay: half the decretal sum to be paid to the respondent and the balance deposited in a joint escrow account, with failure to comply resulting in lapse of the stay.
