Ratio Decidendi

The court found that the application for review was overtaken by events as the applicant sought to withdraw it before a ruling was delivered, and the respondent did not object to the withdrawal save for costs. The court therefore marked the application as wholly withdrawn and ordered the applicant to pay the 1st respondent costs of Kshs 15,000 within seven days, failing which execution for recovery would issue. The court reiterated that a party cannot pursue both review and appeal against the same judgment, and that the memorandum of appeal on record was against the judgment, not the ruling on review. The file was closed save for payment of the assessed costs.
