The court found that although the plaintiff was the registered proprietor of the suit land, the 1st defendant and his family had occupied the land since 1970 under a sale agreement that became void in 1997 for lack of Land Control Board consent. From April 1997, the defendants' possession became adverse to the interests of the registered owner. By April 2009, the defendants had been in adverse possession for over twelve years, and the right to recover the land was extinguished under section 7 of the Limitation of Actions Act.
