The application was fatally defective for failure to comply with the mandatory procedural requirements governing contempt of court proceedings. Specifically, the applicant failed to notify the Attorney General prior to seeking leave as required by Order 52 of the Rules of the Supreme Court of England, which is applicable in Kenya by virtue of Section 5(1) of the Judicature Act. The court found no authority permitting subsequent notification to cure this defect.
