Ratio Decidendi

The court found that there was credible evidence of overlapping and inconsistent implementation of Ministerial awards regarding the suit land, resulting in the exhaustion of land before the Rweru clan's award could be implemented. Given the risk of alienation of the suit properties during the pendency of the suit, the court determined that it was necessary to preserve the status quo by granting an order of inhibition. The court further held that, although costs generally follow the event, the peculiar circumstances of the case warranted that costs of the application be in the cause.
