The applicants demonstrated that they have been in possession of the suit land since the 1960s and would suffer substantial loss, including homelessness and loss of shelter for their families, if evicted before the appeal is heard. The court held that security for due performance was not necessary in this case because the applicants do not hold title to the land, which remains with the respondent and serves as adequate security. Accordingly, the court allowed the application and granted a stay of execution pending the hearing and determination of the appeal.
