Ratio Decidendi

The court held that the applicant, not being a party to the lower court suit (CMCC No. 136 of 2019), lacked locus standi to seek the transfer of the suit or to be enjoined as a defendant in the Environment and Land Court. The proper procedure would have been for the applicant to first apply for joinder in the lower court. Only after being made a party could he then move for transfer or other substantive orders. Since the applicant was a stranger to the proceedings in the lower court, the application was incompetent and bad in law. The court therefore struck out the application with costs, without addressing the merits of transfer or joinder.
