The applicant's occupation was adverse to the respondent's interests, and the respondent's rights had been extinguished by operation of law under the Limitation of Actions Act. The applicant was therefore entitled to be registered as proprietor of the land by virtue of adverse possession, provided the title was still in the respondent's name.
