Procedural Posture

Notice of Motion / Ruling on Application to Set Aside Previous Ruling and for Leave to Defend

  1. 1 Whether the motion to set aside the ruling dated 26.2.2016 is properly before the Court.
  2. 2 Whether the applicants have a right to object to the decree after the previous objection proceedings were struck out.
  3. 3 Whether the application constitutes an abuse of court process.

Ratio Decidendi

The court found that the applicants were not parties to the original proceedings in which the impugned ruling was made. The ruling dated 26.2.2016 merely struck out the objection proceedings on procedural grounds and did not bar the applicants or any other party from raising further objections to the execution of the decree, provided such objections are properly brought before the court. The present application, seeking to set aside the previous ruling and for leave to defend, was therefore deemed improperly before the court. The court held that the application amounted to an abuse of the court process and struck it out with costs to the claimant, declining to consider its merits.
