Procedural Posture

Land and Property Suit / Judgment

  1. 1 Whether the issuance of title to the 1st Defendant was illegal, unlawful, unprocedural, or corrupt and should be nullified.
  2. 2 Whether the Plaintiffs are entitled to allocation of Portion No. Mwapula/Magogoni/467 as ancestral land.
  3. 3 Whether the land should be subdivided between the Plaintiffs and the 2nd and 3rd Defendants' families if both have interests.

Ratio Decidendi

The Plaintiffs failed to discharge the legal burden of proof required to establish that the titles for the disputed property were issued by the 5th and 6th Defendants to the 1st or 2nd Defendants. No documentary evidence, such as title deeds, was produced to support the claim of unlawful issuance of title. The court found that, despite the Plaintiffs' testimony and uncontroverted assertions, the absence of concrete evidence meant that the Plaintiffs did not meet the evidentiary threshold set by Section 107 of the Evidence Act. Consequently, the court dismissed the suit for lack of proof, declining to grant the declaratory and injunctive reliefs sought.
