Procedural Posture

Environment and Land Case / Ruling on Preliminary Objection to Counterclaim

  1. 1 Whether the defendants' counterclaim filed after the close of pleadings without leave of court contravened the Civil Procedure Rules.
  2. 2 Whether the counterclaim should be struck out for being filed without leave after a reply had already been filed.

Ratio Decidendi

The court held that while pleadings may be amended once before closure without leave, once a reply has been filed, any subsequent pleading, including a counterclaim, requires leave of the court as per Order 7 Rule 17(2) of the Civil Procedure Rules. The defendants filed their counterclaim after filing a reply affidavit and without seeking leave of court. The procedural rules are clear and must be adhered to, notwithstanding the constitutional imperative for substantive justice. The counterclaim was therefore improperly filed and was struck out with costs to the plaintiffs.

Court Disposition

Counterclaim struck out with costs to the plaintiffs.

Orders

  • The counterclaim filed on November 22, 2022 is struck out.
  • Defendants to pay costs of the counterclaim to the plaintiffs.
