Ratio Decidendi

The court found that the preliminary objection raised by the 4th respondent regarding the validity of the notice and memorandum of appeal was not properly before the Environment and Land Court, as such matters fall within the jurisdiction of the Court of Appeal. The preliminary objection was therefore dismissed. On the application for stay of execution, the court held that the applicants failed to demonstrate substantial loss as required under Order 42 Rule 6(2) of the Civil Procedure Rules. The evidence showed that the suit land was largely vacant with only uncompleted buildings and a shop, and there was no proof that the applicants would suffer irreparable harm if stay was not granted....
