No. 24625 was the first in time, having been registered in 2004, and is therefore absolute and indefeasible under the Registration of Titles Act (repealed), unless fraud or misrepresentation involving the proprietor is proved, which was not alleged or established by the plaintiff. The plaintiff's title to L.R. No. 31990 was issued much later and overlapped with already existing registered parcels, as confirmed by the Director of Surveys' letter recalling the plaintiff's deed plan. The court held that the 1st defendant's title takes precedence and that the plaintiff failed to establish a prima facie case with a probability of success....
