The court found that Mr. Oyoo, advocate for the plaintiff, did not hold a valid practicing certificate as at 12th July, 2007, as evidenced by the Registrar's circular and the absence of his name on the list of advocates with current certificates. Although a certificate dated 25th September, 2007, was later found on the court file, it did not cure the defect for the period in question. Consequently, all pleadings and applications filed by Mr. Oyoo during the period he lacked a valid practicing certificate were invalid. The court therefore struck out the applications by chamber summons dated 5th April, 2007, and notice of motion dated 4th May, 2007, and set aside any orders obtained...
