The Tribunal found that, based on the evidence, the tenant had not demonstrated that rent was paid for February and March 2020 before the landlord's alleged refusal to accept rent in April 2020. The Tribunal accepted that there was a longstanding practice of paying rent in arrears, but held that the tenant failed to provide sufficient explanation for the non-payment of rent for a period exceeding two months. The Tribunal applied section 7(1)(b) of Cap. 301, which allows for termination of tenancy on grounds of default in rent payment for more than two months.
