Ratio Decidendi

The court found that the Respondent failed to comply with the mandatory requirements of Section 40 of the Employment Act when terminating the Claimant's employment on account of redundancy. The only credible evidence was the redundancy letter issued to the Claimant, and the Respondent did not prove that the redundancy was revoked or that the Claimant was properly offered alternative employment. The Respondent's allegations were unsupported by evidence. Consequently, the redundancy was unlawful and amounted to unfair termination.
