Ratio Decidendi

The court held that the agency relationship created by a power of attorney is terminated by the death of the donee. There is no legal provision allowing for substitution of a deceased donee by another party in such circumstances. The donor of the power of attorney is the only person who can appoint a new attorney, and the court cannot endorse such a transfer. Furthermore, the applicant failed to demonstrate why the donor could not attend court or appoint a new attorney, and no proper application was made for representation. The preliminary objection was therefore upheld, and the application for substitution and for the advocate to come on record was dismissed with costs.
