The court held that a suit filed against a deceased person is a nullity from its inception and cannot be sustained. The preliminary objection raised by the 1st respondent's estate was a pure point of law, as the fact of death was not in dispute. The court found that since Eliud Simon Mbilu was deceased at the time the suit was filed, the proceedings against him were incompetent, null, and void ab initio. The court further held that no grant of representation had been presented and even if one were, it could not cure the nullity. Consequently, the suit against the 1st respondent was struck out, and costs were awarded to the objector.
