The court found that while the appellant had not made a prior commitment to deposit security for costs, Order 42 Rule 6 does not expressly require such a commitment at the application stage. However, the court is mandated to order security for costs if it is inclined to grant a stay. The appellant had filed a notice of appeal within the stipulated time, and the respondent remained in occupation of the suit land, continuing to derive income from it. Granting the stay would not unduly prejudice the respondent. Therefore, the court granted the stay of execution of the ruling and the stay of taxation proceedings, conditional upon the appellant depositing Kshs. 500,000 as security for costs...
