The suit and notice of motion were filed on 1st October 2015, after the expiry of the 90-day period, which lapsed on or about 31st August 2015. The Plaintiff's argument to exclude the court vacation period was rejected, as the registries remained open and there was no legal basis for such exclusion. Consequently, the Plaintiff lacked locus standi to institute the suit or the application, rendering both incompetent.
