Procedural Posture
Land and Property Suit / Direction on Transfer of Suit
Legal Issues
- 1 Whether the Environment and Land Court has jurisdiction to determine disputes relating to succession and administration of estates.
- 2 Whether the suit should be transferred to the High Court for determination as a succession matter.
- 3 Whether the challenge to the Grant of Letters of Administration affects the current proceedings.
Ratio Decidendi
The court determined that the entire claim in the suit concerns properties forming part of the estate of the late Jonathan Keesi Ngunzi, with both plaintiffs and defendants asserting rights as beneficiaries. Since there is also a challenge to the grant of letters of administration, the dispute is fundamentally a succession matter. The Environment and Land Court lacks jurisdiction to determine such issues, which fall within the purview of the High Court (Family Division). Accordingly, the court ordered the transfer of the suit to the High Court in Makueni for appropriate handling as a succession cause.

DIRECTIONS
Upon retiring to write the Ruling in respect of the Notice of Motion dated 26th February 2014, I came to realize that the entire claim in this suit is in respect of the suit properties forming part of the estate of the late Jonathan Keesi Ngunzi. The Plaintiffs and the Defendants are all claiming the suit properties as beneficiaries.
There is also a challenge of the Grant of Letters of Administration granted to the Plaintiffs. Accordingly, I hereby transfer this suit to the High Court in Makueni and direct that it be mentioned before the Presiding Judge of that Court on 28th September 2017. The 9th Defendant to serve the absent parties.
DELIVERED, SIGNED AND DATED AT NAIROBI THIS 15TH DAY OF SEPTEMBER 2017.
