Upon examining the receipts and the sequence of events, the court determined that the payment of Ksh.146,000 could not have been related to the suit as it was made before the suit was filed and before judgment was entered. The Ksh.81,000 was found to have been refunded to the plaintiff's agent on the same day it was deposited, absolving the advocate of liability for that sum. The advocate did not dispute receipt of Ksh.55,000 and Ksh.25,000. The court ordered the advocate to deposit Ksh.80,000 into court for payment to the defendant's...
