The Court of Appeal found that, except for the first appellant, the appellants failed to demonstrate any breach of constitutional or legal provisions in the nomination process for special seats in county assemblies. The Court held that the IEBC Dispute Resolution Committee and the High Court provided fair hearings, and their decisions were based on the evidence presented. The only exception was the first appellant, Alice Wahito Mwangi Ndegwa, whose removal from the party list was effected without according her a hearing, and whose evidence of party membership and nomination was not challenged by the respondents.
