The High Court found that the property in question, Plot Number 3560/2 Section I/MN, was held in joint tenancy by the deceased and the appellant. By operation of Section 49 of the Land Act 2012 and the principle of survivorship, the property did not form part of the deceased's estate and devolved absolutely to the appellant upon the deceased's death. The Kadhi's Court erred in treating the property as part of the estate available for distribution. However, the Kshs. 80,000/= in the deceased's bank account was correctly found to form part of the estate, as it was solely in the deceased's name and not jointly owned.
