Ratio Decidendi

The court found that the order of 21st May, 2001 dismissing the appeal was not supported by the record of 15th February, 2001, which did not contain any order dismissing the appeal for want of prosecution. The court emphasized that, under Order XLI rule 31(1) of the Civil Procedure Rules, an appeal cannot be dismissed for want of prosecution before directions have been taken. Since the record did not show that such directions had been given or that the appeal had been properly set down for hearing, the dismissal was procedurally improper. The court therefore set aside the order of 21st May, 2001 and reinstated the appeal to proceed to hearing after requisite directions are taken.
