Ratio Decidendi

The Court found that since the applicant's appeal had been allowed, the basis for the conditional stay of execution and the requirement for a bank guarantee no longer existed. The guarantee was provided solely to secure the respondents' interests pending the appeal, and with the appeal determined in favour of the applicant, there was no legal justification for its continued retention. The respondents did not oppose the application, and counsel for the 2nd to 6th respondents confirmed that necessary steps for release had already been taken. Accordingly, the Court ordered the Registrar to release the original and any copies of the bank guarantee to the applicant.
