The court found that the Political Parties Disputes Tribunal (PPDT) lacked jurisdiction to entertain disputes regarding party lists after submission to the IEBC, as such jurisdiction is vested exclusively in the IEBC under Article 88(4)(e) of the Constitution and Section 74(1) of the Elections Act. Consequently, the PPDT's decision ordering the preparation of a new party list was null and void. The IEBC erred in implementing the PPDT's decision and gazetting the 2nd, 3rd, and 4th respondents based on an irregular list.
