There was no evidence that the proceedings were ever supplied to the appellants. In view of the right to fair hearing and the fact that the record of appeal was eventually filed, albeit without the certified proceedings, the court held that the application had merit. The dismissal order was set aside, the appeal reinstated, and a conditional stay of execution was granted, subject to the appellants depositing Kshs. 100,000 as security within 45 days.
