Procedural Posture

Criminal Appeal / Ruling on Application for Review of Bail Refusal

  1. 1 Whether referring to the applicant as a convict instead of a remandee in the previous ruling constituted an error apparent on the face of the record.
  2. 2 Whether the error occasioned a failure of justice warranting review or alteration of the previous ruling refusing bail.

Ratio Decidendi

The court found that although the applicant was erroneously referred to as a convict in the previous ruling, this mischaracterization did not occasion a failure of justice. The substantive reasons for refusing bail were set out in other parts of the ruling and were not dependent on the applicant's status as a convict or remandee. The court therefore declined to interfere with the conclusion reached in the earlier ruling but corrected the record to accurately reflect the applicant's status as a remandee awaiting trial.

Court Disposition

Application for review of bail refusal dismissed; record corrected to reflect applicant's status as remandee.

Orders

  • Paragraphs 1, 2, and 5 of the ruling dated 20th December 2012 are corrected to accurately describe the applicant as a remandee and not a convict.
  • The third sentence of paragraph 5 of the previous ruling is deleted.
