The court further determined that the delay in prosecuting the appeal was not attributable to the appellant, as the unavailability of the lower court file was beyond its control despite repeated efforts to obtain it. The court held that it would be unjust to penalize the appellant for circumstances outside its power and dismissed the Motion for dismissal of the appeal.
